Meeting of November 20, 2019 - EEOC Convenes Public Hearing on the Proposed Revision of the Employer Information Report (EEO-1)

As Director, Regulatory Affairs for Berkshire Associates, Lynn oversees Berkshire's audit defense practice, helping clients respond to hundreds of government investigations since she joined the consulting firm in 2014. With over 20 years of experience, Lynn also serves as a strategic advisor to clients with respect to EEO/AA and pay equity issues and regularly helps clients develop robust compliance and diversity programs through client training and policy and program development.

Prior to joining Berkshire, Lynn was a shareholder at the management-side employment law firm of Jackson Lewis P.C., where she counseled and advised clients on OFCCP and EEO compliance issues, and other workplace laws. She regularly represented employers during investigations, audits, and other enforcement activities by local, state, and federal government agencies, including those involving large-scale class allegations.

From 2001-2008, Lynn served in several senior-level policy positions at the U.S. Department of Labor (DOL) and the EEOC. During this time, Ms. Clements served as the Acting Director/Deputy Director of the Policy Division of the Office of Federal Contract Compliance Programs (OFCCP), where she oversaw all policy and regulatory initiatives, including the OFCCP's systemic discrimination and compensation audit protocols, and its implementation of the Internet applicant rule and online accessibility requirements. From 2001 to 2006, Lynn served as a Special Assistant to the Vice Chair and Legal Counsel at the EEOC, where she advised agency officials on high-profile policy and enforcement actions, including the agency's systemic discrimination initiative. She was responsible for drafting or reviewing the agency's regulatory and policy proposals during this period, including any regulations and enforcement guidance issued by the agency. During her government service, she was selected in 2005 as a finalist for the prestigious Service to America Medals.

Prior to her government service, Lynn was in private practice where she counseled employers on all aspects of the employment relationship. Her practice focused on labor and employment litigation in federal and state courts, as well as federal and state administrative agencies.

A frequent speaker to HR professionals of all levels at national and local events, Lynn has testified before Congress on EEO and pay equity issues and regularly assists industry organizations, including SHRM and CUPA-HR, in understanding and responding to regulatory proposals. She is currently Secretary for the Baltimore Industry Liaison Group (BILG) and a faculty member at the Institute for Corporate Equality. Lynn graduated summa cum laude with a B.S. and B.A from Wilkes University. She earned her J.D. cum laude from Georgetown University Law Center.
