EEOC Releases Performance and Accountability Report Under New Strategic Plan

The U.S. Equal Employment Opportunity Commission (EEOC) finished fiscal year 2012 with record high monetary recoveries for victims of discrimination, as well as a significant decrease in its inventory of pending cases, the agency announced in its Performance and Accountability Report  (PAR) released Nov. 16.  This is the first performance report compiled under the standards of the EEOC's new Strategic Plan adopted on February 22, 2012, after comprehensive review and significant public input.  The new plan took effect in March, 2012.

EEOC's Denver Office Enters into Memorandum of Understanding with Mexican Consulate

The Denver Field Office of the U.S. Equal Employment Opportunity Commission (EEOC) entered into a Memorandum of Understanding with the Consulate of Mexico in Denver today.  The agreement establishes an ongoing collaborative relationship between these two entities to provide Mexican nationals with information, guidance, and access to resources on the prevention of discrimination in the workplace, regardless of documentation status.  Mexican Consul General Andrés Chao and Rayford O. Irvin, director of the EEOC's Phoenix District Office, signed the agreement.

Sixth Circuit Overturns Award of Attorney Fees Against EEOC

The U.S. Equal Employment Opportunity Commission (EEOC) should not have been ordered to pay $2.6 million in attorney fees and was wrongly denied permission to litigate a lawsuit alleging sex discrimination against a class of women in Michigan, the U.S. Court of Appeals for the Sixth Circuit (6th Cir.) ruled in an opinion issued on Friday, November 9.  The ruling overturned the district court's dismissal of the EEOC's lawsuit against Cintas Corporation, reversed significant procedural rulings, and found "no basis" for awarding Cintas attorney fees.

Interstate Distributor Company to Pay Nearly $5 Million to Settle EEOC Disability Suit

Interstate Distributor Company will pay $4.85 million and provide other significant relief to settle a nationwide class disability discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC's suit said the nationwide trucking firm unlawfully denied reasonable accommodations to hundreds of employees and fired them pursuant to Interstate's maximum leave policy.

Hotspur Resorts, JW Marriott Franchisee, Settles EEOC Sexual Harassment Suit for $155,000

The U.S. Equal Employment Opportunity Commission (EEOC) today announced that Hotspur Resorts Nevada Ltd., a franchisee doing business as the JW Marriott Las Vegas Resort, Spa & Golf, will pay $155,000 to settle an EEOC lawsuit charging that the resort's Irish pub, J.C. Wooloughan's, subjected three female employees to sexual harassment.

Señor Frog's, Altres Sued By EEOC For Severe, Rampant Sexual Harassment

Señor Frog's, a popular chain of Mexican-themed restaurants and bars, violated federal law by allowing the rampant sexual harassment of its female employees in Honolulu by high-level officials including the company owner, the U.S. Equal Employment Opportunity Commission (EEOC) charged in a lawsuit it filed today against both Señor Frog's and Altres, Inc.  Altres, a Hawaiian staffing company, was contracted by Señor Frog's to provide human resources services and oversee the company's non-management staff at the Señor Frog's restaurant & bar in Honolulu.

Capri Home Care, Inc. settled an employment discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC) for $23,000 and other relief, the agency announced today.  The EEOC sued Capri for not hiring a pregnant woman into a billing clerk / administrative assistant position at its Clearwater, Fla., corporate office.  Capri is a leading home health agency providing skilled nursing and specialized home health care throughout Central Florida.

EEOC Wins Summary Judgment on Liability in Baltimore County Pension Case

A federal judge has granted summary judgment against Baltimore County in favor of the U.S. Equal Employment Opportunity Commission (EEOC), the federal agency announced today.  In so doing, the judge found that Baltimore County's pension plan, known as the Employee Retirement System (ERS), violates the Age Discrimination in Employment Act (ADEA) because the plan is inherently discriminatory.  U.S. District Judge Benson Everett Legg also denied Baltimore County's motion for summary judgment.

DuPriest and Sons To Pay $24,000 to Silk-Screener Fired Because of Disability

DuPriest and Sons Holding and other related entities that owned and operated a Dallas silk-screening company have agreed to pay a long-term former employee $24,000 to settle a disability discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC had charged that DuPriest violated the Americans with Disabilities Act (ADA) by selecting an employee for layoff because of a recent hospitalization for diabetes and kidney failure.

EEOC Wins Rare Partial Summary Judgment Ruling in Racial Harassment Case

A federal judge has granted partial summary judgment in favor of the U.S. Equal Employment Opportunity Commission (EEOC) and denied an employer's motion for sanctions in an EEOC class racial harassment case against a Utah construction company, the federal agency announced today.  In so doing, the judge found that three black employees were subjected to an objectively hostile work environment and that the employer may not assert an affirmative defense to liability.  United States District Judge Dale A. Kimball also denied the employer's motion for sanctions, characterizing it as "wholly without merit."
