Perdue Farms Settles EEOC Age Discrimination Suit

Perdue Farms, Inc. will pay $25,500 to settle an age discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The EEOC had charged in its lawsuit that Perdue Farms violated the Age Discrimination in Employment Act (ADEA) by refusing to hire a woman for a position because of her age.

EEOC Collects on $471,000 Jury Award after Winning Appeal from Waterproofing Company  In Sex Harassment Case

The Equal Employment Opportunity Commission (EEOC) announced today that Everdry Marketing and Management has paid $471,096 in damages, plus $86,581 in post-judgment interest, to 13 victims of sexual harassment.  The payout satisfies a judgment obtained by EEOC against Everdry in October 2006 following a four-week trial in Rochester, N.Y. (case # 01-CV-6329).  The individual payouts range from about $24,000 to $56,000, including the interest, which covers the time the women had to wait to receive their jury awards.  Everdry was required to pay the substantial interest after the ultimate resolution of the case was delayed by an appeal Everdry filed in the U.S. Court of Appeals for the Second Circuit challenging various aspects of the jury's verdict and other district court rulings.  The Court of Appeals affirmed the jury's verdict and award of damages.

Selden Fire District To Pay $263,360 To Settle EEOC Age Discrimination Suit

The Selden Fire District Selden in Suffolk County, Long Island, will pay $263,360 to settle a class age discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The damages will be made in retroactive payments to a group of 23 firefighters who had been discriminated against based on their age and provide increased monthly pension amounts going forward to several firefighters.

EEOC Obtains $122,500 from Houston Construction Company for Religious, Race and National Origin Discrimination

A Houston-area construction company will pay $122,500 and provide additional remedial relief to resolve a discrimination lawsuit filed by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today.  The EEOC had charged that Pace Services, L.P. discriminated against Mohammad Kaleemuddin because he is of the Islamic faith and of East Indian descent, and against 13 other employees because they are black or Hispanic.

Victoria A. Lipnic, a former U.S. Assistant Secretary of Labor, was sworn in today as a Commissioner of the U.S. Equal Employment Opportunity Commission (EEOC).  She was nominated on Nov. 3, 2009, and received a recess appointment to the position by President Barack Obama on March 27, 2010.

Alabama KFC Owner to Pay More than $1 Million to Settle EEOC Sexual Harassment Suit

The U.S. Equal Employment Opportunity Commission (EEOC) announced today that Jack Marshall Foods, Inc., doing business as Kentucky Fried Chicken, Inc., a Tuscaloosa, Ala.-based company, will pay a group of about 19 female employees, including at least three who were teenagers at the time they were employed there, $1,052,000 and furnish significant remedial relief to settle a lawsuit brought by the federal agency charging sexual harassment.

Cannon & Wendt to Pay $100,000 to Settle EEOC  National Origin Discrimination / Retaliation Suit

The U.S. Equal Employment Opportunity Commission announced today that it has settled a national origin discrimination and retaliation lawsuit against Cannon & Wendt Electric Co., Inc., one of the oldest and largest electrical contractors operating in Phoenix, Ariz., for $100,000 for Victor Cortez and a comprehensive consent decree, signed by Federal Judge Earl H. Carroll.

Bayville Fire Company Settles EEOC Age Discrimination Suit

The Bayville Fire Company on Long Island has agreed to settle a class age discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced today. The fire company, as well as the Villages of Bayville, Mill Neck, and Centre Island, will pay a group of about 15-18 firefighters lost pension money and provide increased monthly pension amounts going forward to several firefighters. Depend­ing on how many class members are finally definitively identified and the exact damages established for each one, the final total damages should be $180,000 to $240,000.
